1. scope of application
The use of this website and the business relationship between rugenbraeu.ch (Rugenbräu AG Wagnerenstrasse 40 3800 Matten bei Interlaken) and its customers are governed by the following General Terms and Conditions (GTC) in the version currently available and valid when the website is accessed or goods are ordered. The offer on this website is aimed exclusively at customers resident in Switzerland or Liechtenstein. Delivery abroad is generally not intended and requires individual agreement.
A customer is any natural or legal person who maintains business relations with rugenbraeu.ch. The GTC, the terms of delivery and payment and the data protection provisions may be amended from time to time. rugenbraeu.ch asks its customers to read these provisions carefully each time they visit the website and each time they order goods.
These GTC apply exclusively. Conflicting, supplementary or deviating terms and conditions require the express written confirmation of Rugenbräu AG in order to be valid. When using this website or ordering goods, the rugenbraeu.ch customer confirms full acceptance of these GTC, including delivery and payment conditions.
Should individual provisions of these GTC prove to be invalid or unenforceable or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.

3. prices
Unless otherwise stated, the prices quoted by rugenbraeu.ch include statutory VAT, any advance recycling fees (VRG) and copyright levies. Prices are quoted net in Swiss francs (CHF).
Unless otherwise stated, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the order process.
Technical changes, errors and misprints are reserved, in particular rugenbraeu.ch can make price changes at any time and without prior notice until the order confirmation, unless there are legal requirements for price changes (e.g. change in VAT). Consulting and support services are not included in the sales prices.

4. conclusion of contract
The offers on this website represent a non-binding invitation to the customer to order products and/or services from rugenbraeu.ch. By placing an order via this website, including acceptance of these GTC, the customer submits a legally binding offer to conclude a contract. By placing an order, the customer confirms the accuracy of all information provided. Rugenbräu AG then sends an automatic "order confirmation" by e-mail, which confirms that the customer's offer has been received by rugenbraeu.ch. Orders placed are binding for the customer.
The contract is concluded as soon as rugenbraeu.ch sends a declaration of acceptance by e-mail, in which the dispatch of the ordered products or services is confirmed.
orders are only delivered after full payment has been received and if the goods are available. If it becomes apparent after conclusion of the contract that the ordered goods cannot be delivered or cannot be delivered in full, Rugenbräu AG is entitled to withdraw from the entire contract or from part of the contract. If the customer's payment has already been received by rugenbraeu.ch, the payment will be refunded to the customer. If no payment has yet been made, the customer is released from the obligation to pay. Rugenbräu AG is not obliged to make a replacement delivery in the event of the contract being terminated.

5. payment options and retention of title
The payment options specified in the order process are available to the customer. The standard options are online Postfinance, credit cards (Visa and Mastercard), PayPal. Orders placed on www.rugenbraeu.ch must be paid for by credit card.
The prices, conditions and vintages on the day of the order apply. We expressly reserve the right to adjust prices due to changes in shipping costs, taxes or fees.
The products delivered to the customer remain the property of Rugenbräu AG until full payment has been received.

6. delivery, obligation to inspect, notification of defects and return
Deliveries are sent by courier service "Planzer" to the address specified by the customer in the order. Invoices are sent by e-mail or by post. Upon dispatch, the benefits and risks are transferred to the customer, insofar as this is legally permissible.
If the delivery cannot be delivered or if the customer refuses to accept the delivery, rugenbraeu.ch may terminate the contract after notifying the customer by e-mail and setting a reasonable deadline, and invoice the customer for the costs incurred.
The customer is obliged to inspect the delivered goods immediately upon receipt of the delivery and to report any defects immediately in writing by letter or e-mail.
Returns to Rugenbräu AG are at the expense and risk of the customer. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery bill and a detailed description of the defects to the return address specified by rugenbraeu.ch in the imprint.
If the inspection by Rugenbräu AG reveals that the goods have no detectable defects or that they are not covered by the manufacturer's warranty, Rugenbräu AG may charge the customer for the expenses, the return shipment or any disposal.

7. right of withdrawal
The customer is granted a right of withdrawal for 14 calendar days after receipt of the goods. The deadline is deemed to have been met if the customer sends the written revocation by e-mail (office@rugenbraeu.ch) or letter (Rugenbräu AG Wagnerenstrasse 40 3800 Matten bei Interlaken) to rugenbraeu.ch within the deadline. The revocation does not require any justification.
The exercise of the right of revocation leads to a reversal of the contract. The customer must return the goods within 14 calendar days in their original packaging, complete with all accessories and together with the delivery bill to the return address specified by rugenbraeu.ch (Rugenbräu AG Wagnerenstrasse 40 3800 Matten bei Interlaken). Returns are made to rugenbraeu.ch at the expense and risk of the customer. Any payment already made will be refunded to the customer within 20 calendar days of receipt of the goods in their original packaging by Rugenbräu AG.
rugenbraeu.ch reserves the right to demand appropriate compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the reduction in value from the purchase price already paid or to invoice the customer for it.
No right of withdrawal is granted in the following cases:
(i) If the contract concerns a movable item that is manufactured according to the consumer's specifications or is clearly tailored to personal needs;

8. no sale to minors
In Switzerland, alcoholic beverages may not be sold to minors under the age of 16, and spirits may not be sold to minors under the age of 18. By placing an order on rugenbraeu.ch, the customer acknowledges these provisions and confirms that he/she is authorized to make the purchase. Rugenbräu AG declines all liability in the event of non-compliance.
In cases of suspicion, Rugenbräu AG reserves the right to request further evidence of the customer's compliance with the requirements.

9. warranty
rugenbraeu.ch endeavors to deliver goods of impeccable quality. In the event of defects notified in good time, rugenbraeu.ch shall assume the warranty for the freedom from defects and functionality of the item purchased by the Customer during the statutory warranty period of generally two years from the date of delivery. It is at the discretion of rugenbraeu.ch to provide the warranty by equivalent replacement or by reimbursement of the purchase price. Further claims are excluded.
The warranty does not cover normal wear and tear or the consequences of improper handling or damage by the customer or third parties or defects caused by external circumstances. The warranty for consumables and wearing parts is also excluded. Liability for exceeding the date of consumption is also excluded.
rugenbraeu.ch does not give any assurances or guarantees as to the currency, completeness or accuracy of the data or as to the permanent or uninterrupted availability of the website, its functionalities, integrated hyperlinks or other content. In particular, no representation or warranty is given that the use of the website will not infringe rights of third parties not owned by rugenbraeu.ch.

10. liability
Rugenbräu AG excludes all liability, irrespective of its legal basis, as well as claims for damages against rugenbraeu.ch and any auxiliary persons and vicarious agents. In particular, Rugenbräu AG is not liable for indirect damages and consequential damages, loss of profit or other personal injury, property damage or pure financial loss suffered by the customer. Further mandatory statutory liability, for example for gross negligence or unlawful intent, remains reserved.
rugenbraeu.ch only uses hyperlinks to simplify the customer's access to other websites. Rugenbräu AG cannot know the content of these websites in detail, nor can it assume any liability or other responsibility for the content of these websites.

11. data protection
rugenbraeu.ch may process and use the data collected during the conclusion of the contract to fulfill the obligations arising from the purchase contract and for marketing purposes. The data required to fulfill the service may also be passed on to contracted service partners (logistics partners) or other third parties.

12. further provisions
Rugenbräu AG expressly reserves the right to amend these GTC at any time and to bring them into force without notice.
In the event of disputes, Swiss substantive law shall apply exclusively, to the exclusion of conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.
The place of jurisdiction is the registered office of Rugenbräu AG, unless the law provides for mandatory places of jurisdiction.

13. copyright notice
All rights, namely copyrights, to these GTC are held by Rugenbräu AG.
Any reproduction, distribution or other use is prohibited and only permitted with the express written consent of Rugenbräu AG. Rugenbräu AG reserves the right to take all legal action in the event of a breach of this provision.

We would like to point out that all legal requirements (federal laws, cantonal regulations, (emergency) ordinances of the Federal Council, directives of the health authorities, etc.) in particular must be observed and taken into account when using, advertising and reselling. In this context, Rugenbräu AG reserves the right to terminate the contractual relationship unilaterally and at any time in cases of suspicion or violations of any kind, even if the purchase price has already been paid, to terminate the contract with immediate effect, to refuse deliveries and to refund any payments already made to the contractual partner in such a case. The contractual partner declares to comply with these requirements upon conclusion of the contract and, in the event of unilateral termination of the contract by Rugenbräu AG, to agree that any claims (in particular damages, compensation, etc.) are excluded to the extent permitted by law and that our GTC shall otherwise apply.
